Grievance Report October 19, 2024
Grievance 6035-24 - Article 15 Discipline, School Site Aide, Inappropriate conduct with a student was denied. Filed for Arbitration in concurrence with a PERB Charge. A formal hearing has a tentative date of December 16, 18 & 19 if necessary.
Grievance 9801-24 -  Article 13 Overtime and Article 14 Probation. Overtime worked by Probationary Employees. Outcome was denied. Filed for Arbitration.
Grievance 1061-24 - Article 10 Job Vacancies, Sr. Custodian had most seniority did not get the transfer of position was sustained. Discussion on decision. A follow up meeting has been scheduled for Wednesday October 23, 2024. Richard mentioned there were three criteria that they look at: 1) experience/knowledge, 2) physical capability and, 3)seniority.

Members who have worked for the District after 7 years as a Classified Employee should, according to the Salary Schedule be moved to Step VI, Members who have completed 10 years of Classified Service with the District should move to Step VII. Waiting for recognition from State Mediation.

Grievance #4039 – 24 – Article 13 – Overtime Employees not being able to use their Comp time according to CBA within a year of earning and recording time. Moved to Step III, State Mediation date January 6, 2025 Supervisor refused to meet with USW after a request was made this is another violation of the CBA Article 16- Grievance Procedure. The supervisor automatically “cashed” out the overtime instead of offering the Comp time for the full 12 months.

Grievance #9702-24 – Article 10 – Job Vacancies & Article 16 – Grievance Procedure for the District Security Lead Position. USW met with Supervisor Kris Stevens on November 20, 2024, in this meeting, Supervisor agreed to resolve the Grievance at the Pre-Grievance Level. The resolution was for the most Senior Employee to receive the position. USW was awaiting conformation from HR because HR told another member that they were awarded the position. In the meeting on December 10, 2024 the original awarded member, Supervisor, USW and Rita were in the meeting. The member was told that because of the Supervisors decision in the Pre-Grievance Meeting, that they would not be granted the position, the position would be granted to the Grievant. In a meeting on December 13, 2024, Interim Associate Superintendent of HR, Director of HR, USW, Supervisor and both members affected by the Grievance determination met again. In this meeting, HR back pedaled on the agreement that was settled in the Pre-Grievance Meeting and told the original member that they would indeed be awarded the position. After discussion with Marly and the USW Attorney, they said to file an additional Grievance for the violation of Article 16 – Grievance Procedure and Article 10 – Job Vacancies for not adhering to the agreement made in the Pre-Grievance Meeting.

The District offered a settlement agreement. We will be discussing the outcome in our next meeting scheduled for February 5, 2025.

School Site Aide, Unilateral Change to discipline by removing the employee from the site instead of progressive discipline. In concurrence a PERB charge has been filed. Withdrew from PERB will continue to pursue this through Arbitration.

Step III - State Mediation meeting was scheduled for November 6, 2024. We have a signed document and assurance these will never be used for any type of discipline.

They each got half of their comp time back in vacation as compensation. Supervisor refused to meet with USW after a request was made this is another violation of the CBA Article 16- Grievance Procedure. The supervisor automatically “cashed” out the overtime instead of offering the Comp time for the full 12 months.

Filed for Arbitration.  Settlement Agreement June 9, 2025, Member is allowed to go back to sub at original site. Letter of Warning will be removed on December 1, 2025. Withdraw Grievance with Settlement Agreement.

Grievance 3062 - 25 Article 12 – Hours of Work.  Member not permitted to continue working Additional Assignment in Food Services. Pre-Grievance Meeting held. Filed in Step I. Settlement Agreement June 9, 2025. Member back paid for hours missed as a result of not being permitted to work additional hours. Back pay will be paid on June 30, 2025 with applicable interest.

We will have the formal hearing December 16, 18 & 19 if necessary. Dawn, Richard, the Member and Marly had the formal hearing with the Administrative Law Judge. We completed questioning and cross questioning of the Districts’ witness Rita Bayne and our Witness on Monday December 16, 2024. We have ordered the Official Transcript of the Hearing. After we receive the document, we will be going through the testimonies and writing or Closing Statement, that is due by February 14, 2025. Waiting final ruling, submitted Closing Statement by deadline.

Grievance 1066-25 SAT Team Article 12 Hours of Work, Sub Section Working Out of Classification. SAT Team Members are being asked to take trainings that are not in their job descriptions and then use those trainings to do the work that is not in their job descriptions. Forklifts and Aireal lifts. Waiting for State Mediation. 
Grievance 9603-25 – Article 8 Non Unit and Hourly Employees.  School Site Aides & Instructional Support Aides. May 28, 2025 USW was made aware the ELEVO was going to be used for arrival and dismissal time at busses. Brought to the attention of Executive Directors of Elementary Instruction. USW said this displaced SSAs from the duties. Article 8 Non-Unit Hourly Employees. Executive Directors said Elevo has “extra hours” to use up. They agreed to stop this. On June 9, USW was made aware that Elevo was still at arrival and dismissal of busses. Pre-Grievance Meeting. Summer BLAST Program was over on June 19. On June 11, they shifted the SSAs three-hour consistent three-hour schedule to one hour in the morning and then come back for two hours. We felt this was retaliation. Additionally, Instructional Support Aides were being displaced by Elevo. We filed an Information Request to find out which SSAs and which ISAs were asked to work. We confirmed that only two SSAs from each site were asked to fill the positions. In conclusion. If three or four SSAs were asked to confirm their availability to work for the three-week program we are certain they would have had the confirmed participation. This Grievance is waiting for resolution at Step II with the District.
Grievance 5027-25 General Maintenance Workers Article 8 Non-Unit and Hourly Employees and Article 12 Hours Worked Sub Section Maintenance Trainee Work Program. M & O is hiring Substitute General Maintenance Workers and using them as regular daily workers displacing the need to hire Classified General Maintenance Workers or utilizing the short term abilities to further the experience of other Maintenance employees that could gain experience in the Trades by participating in the Maintenance Trainee Work Program. Progressed this Grievance to Step II.
