Grievance #9801 – 24 – Article 13 Overtime & Article 14 Probation, Overtime worked by Probationary Employees. Outcome – Denied. Filed for Arbitration. Grievance #9803-24 – Article 34 – Salaries & Fringe Benefits, Members who have worked for the District after 7 years as a Classified Employee should, according to the Salary Schedule be moved to Step VI. Moved to Step III, Moved to a future Mediation meeting. Filed for Arbitration
Grievance #1064-25 – Article 12 Hours of Work and Article 15 Suspension/Discharge Cases. Member being accused of taking unscheduled break and dishonesty. Pre-Grievance Meeting 4/14/2025 Filed at Step 1. Presented to the Board on February 11, the Board Denied it was a Grievance. In discussion with Marly for next steps. Dawn met with Custodial Supervisor, all charges were dropped, nothing in this members file. Should have been a conversation.
Grievance #1065-25 Article 15 Suspension and Discharge Cases and Article 40 District Video Cameras and Time Clocks. Member being accused of driving too fast on golf cart. Pre-Grievance Meeting on 4/11/2025.Filed, at Step I. Presented to the Board on February 11, the Board Denied it was a Grievance. In discussion with Marly for next steps. Grievance #7008-25 - Article 4 – Non-Discrimination and Article 43 – Union Rights, District is discriminating against member for Union action in a 12 – month work capacity for the past 5 years showing Past Practice. Advanced to Step III, Mediation March 12th.
Grievance #5029-25 – Article 4 Non- Discrimination & Article 13 Overtime. Member skipped for overtime due to being on light duty. Advanced to Step III, Mediation.
Grievance #9809-25 – Article 11 – New or Changed Job Classification and Article 12 – Hours of Work – Class Action for Hearing Impaired Aides for Itinerant not being in their job description and performing educational interpretation. Progressed to Step II waiting for District response.
PERB Charges Outstanding.
LA – CE – 6874 – E, filed 3/29/2024, School Site Aide Forbidden from talking to coworkers within work hours or outside of work hours. We will have the formal hearing December 16, 18 & 19 if necessary. Dawn, Richard, the Member and Marly had the formal hearing with the Administrative Law Judge. We completed questioning and cross questioning of the Districts’ witness Rita Bayne and our Witness on Monday December 16, 2024. We have ordered the Official Transcript of the Hearing. After we receive the document, we will be going through the testimonies and writing or Closing Statement, that is due by February 14, 2025. Final ruling, PERB ruled Cease and Desist from our member talking to other members, District must post on all union posting boards for 30 days the ruling, post electronically. USW received help form International Legal to file last rebuttal to seek pay for lost opportunity of summer assignment work. We filed an appeal 1/16 to prove the grievant lost the opportunity for summer assignments. Went for final appeal to PERB Board on the docket January 27, 2026. PERB Board denied the appeal to pay for lost time for summer assignment for our member. Closed case.
